About YourCause Compliance Agreements

The standard YourCause Compliance Agreements for all organizations are detailed below. You can also view these descriptions in NPOconnect when managing compliance.

Note: Some companies may require organizations to agree to custom compliance agreements in to be eligible to receive funds. If this is the case, these agreements will appear alongside the YourCause Compliance Agreements in the Compliance / Affirmations area.

Affirmation of Compliance with Non-Discriminatory practices Non-Discrimination Policies must apply to all projects or programs funded to the organization by YourCause corporate clients. By agreeing to this compliance statement you are affirming that the grantee will not discriminate against a person or group on the basis of race, religion, color, national origin, age, sex, gender identity, disability, status as a disabled veteran, political preference, sexual orientation, pregnancy, membership or non-membership in any lawful organization, or other basis prohibited by local laws or regulations.
Affirmation of Compliance with Non-Religious program support Some YourCause corporate clients have specific requirements regarding grants to religious organizations. Please affirm, if applicable, the following on behalf of your organization: The grantee will use funds to support only those programs that : (a) are open to all individuals in the community regardless of religious belief; (b) serve a secular purpose, such as a food pantry or a homeless shelter; and (c) do not require individuals to join in religious worship to receive the services that the nonprofit offers.
Affirmation of Compliance with USA Patriot Act Patriot Act: The grantee will not use any portion of the grant funds to support or promote violence, terrorist activity or related training of any kind, either directly or indirectly (including through support of other organizations or persons engaged in such activity). In addition, the organization affirms the nonprofit is not a charitable organization designated by the U.S. Treasury Department’s Office of Foreign Assets Control as Specially Designated Nationals or Blocked Persons.
Affirmation of Compliance with Anti-corruption and Anti-bribery laws Affirmation of compliance with anti-corruption and anti-bribery laws: Your organization commits to using the services, products, cash or other benefits that are subject of the grant solely for the benefit of your organization, in a manner that reflects the highest standards of integrity and ethical conduct and in accordance with all laws, rules and regulations applicable to your organization, including without limitation all applicable anti-corruption and anti-bribery laws. You agree that no individual associated with or employed by your organization will improperly benefit, whether directly or indirectly, from the grant. You agree that this grant is not intended to influence, and will not influence, the procurement decisions of your organization or any organization with which your officers, board members or trustees or their family members are employed or otherwise affiliated.

Your organization will not directly or indirectly make or give, offer or promise to make or give, or authorize the making or giving of any payment, gift, or other thing of value or advantage to any person or entity for (a) the purpose of wrongfully influencing any act or decision, inducing any act or omission to act in violation of a lawful duty, inducing a misuse of influence or securing any improper advantage, or (b) any purpose that is otherwise unlawful under any applicable anti-corruption or anti-bribery laws, where in either case (a) or (b) there is any direct or indirect connection or relation to the grant.
Affirmation of Compliance with Blackbaud Giving Fund terms U.S. Grant Terms: Any grant issued by The Blackbaud Giving Fund is subject to the following terms. By accepting any grant from The Blackbaud Giving Fund, you represent to The Blackbaud Giving Fund that (i) your organization is formed under the laws of the U.S. and its territories and is a public charity described in IRC secs. 509(a)(1)-(3), a political subdivision of the United States, a State, a possession of the United States within the meaning of Section 170(c)(1) of the Code of the Internal Revenue Code of 1986 or a private operating foundation described in IRC sec. 4942(j)(3); (ii) this grant will be used exclusively for your organization’s exempt purposes; (iii) neither the recommending donor nor any other donor-affiliated party will receive goods, services or impermissible benefits ( e.g., tuition, memberships, dues, admission to events or goods bought at action, or anything of more than incidental benefit) as a result of the grant; (iv) the grant will not be used for political contributions or campaign activities; and (v) your organization does not devote more than an insubstantial part of its activities to attempting to influence legislation by propaganda or otherwise.

International Grant Terms: Any grant issued by The Blackbaud Giving Fund is subject to the following terms. By accepting any grant from The Blackbaud Giving Fund, you represent to The Blackbaud Giving Fund that (i) your organization is the equivalent of a U.S. tax exempt organization described in IRC sec. 501(c)(3) and of a public charity described in IRC secs. 509(a)(1)-(3) or a private operating foundation described in IRC sec. 4942(j)(3); (ii) the grant will be used exclusively for your organization's exempt purposes; (iii) neither the recommending donor nor any other donor-affiliated party will receive goods, services or impermissible benefits ( e.g., tuition, memberships, dues, admission to events or goods bought at action, or anything of more than incidental benefit) as a result of the grant; (iv) the grant will not be used for political contributions or campaign activities; (v) your organization does not devote more than an insubstantial part of its activities to attempting to influence legislation by propaganda or otherwise; and (vi) the grant shall not be used in violation of OFAC regulations, involving target countries or individuals or entities listed on the Specially Designated Nationals and Blocked Persons list.
